Easterseals President & CEO Kendra Davenport's Comments on DOJ Opinion Breaking From Olmstead

After the Justice Department issued an opinion arguing that states aren't required to provide Medicaid home care and disability services, disability advocates strongly objected to the administration's approach.

While Olmstead remains the law, recent Department of Justice guidance marks “a dangerous break from decades of precedent and federal enforcement supporting community integration” under the ADA and Section 504, according to Easterseals President and CEO and President Kendra Davenport.

“This new interpretation attempts to dismantle access to vital home care and threatens to separate people from their families and warehouse them,” Davenport said in an email statement to McKnight’s Home Care Daily Pulse. “It creates uncertainty around protections that generations of advocates fought to secure.”
