Advocacy organizations Monday were still grappling with the Department of Justice’s decision Friday to cease enforcing guidance related to the Olmstead decision, which found that people with disabilities have a constitutional right to receive non-institutionalized care.
“Olmstead remains the law, but the Department of Justice’s new interpretation is a stunning abandonment of people with disabilities and the decades of progress that made community living possible,” Kendra Davenport, president and CEO of Easterseals, which provides services to children and adults with disabilities, caregivers, older adults, veterans and their families, told McKnight’s Home Care Daily Pulse.
“For people who rely on home care, this threatens their freedom, independence and ability to remain with their families. It also leaves home care agencies to shoulder even more responsibility while facing Medicaid cuts, severe workforce shortages and growing demand.”
